PCA Services (a part of POSC Caesar Association) is the provider of this service and the owner of this site.
The use of this site, the services provided through these sites, any provision of information from PCA Services related to this site and your use of any of the downloads and/or other products and information related to this site is governed by these Terms of Use. By using this site, you acknowledge that you accept and will be bound by the terms and conditions presented here.

Monitoring

For site security purposes and to ensure that this website remains available to all users, PCA Services monitors network traffic to identify unauthorized attempts to upload or change information or to otherwise cause damage to the site. Anyone using this website expressly consents to such monitoring. If monitoring reveals evidence of possible criminal activity, such evidence will be provided to the appropriate authorities. Unauthorized attempts to modify any information stored on this system, to defeat or circumvent security features, or to utilize this system for other than its intended purposes are prohibited and may result in criminal prosecution.


Product

The content and software presented at these Internet sites at any time (‘the Product’) is a proprietary product of PCA Services and all intellectual property rights to the Product vests in PCA Services. However, some of the terms and definitions used are based on various publications from the International Organisation for Standardisation (ISO) and other standardization organizations, PCA Services hereby acknowledge the said standardization organisations’ proprietary and intellectual property rights to these publications.


License to use

After accepting these Terms of Use, PCA Services grants you (the ‘User’) a revocable, non-exclusive, royalty-free right to use parts of or the entire Product or any content retrieved from the Product for own internal use. The User has right to use the content of the website when providing services to the User’s customers and suppliers for the purpose of ensuring a common understanding in the relevant area of business of which the User is operating. However, the latter does not include such commercial distribution as mentioned in the below ‘Restrictions on use’ item b), nor does it include commercial exploitation of parts or the entire product as such. PCA Services retains the ownership of the content and software all the way from the Product to the User.

Restrictions on use

Subject to the above ’License to use’, the User may not:

  1. Reproduce, retransmit, publish, disseminate, distribute, sell, license, sublicense, lease, broadcast or circulate or otherwise use any data retrieved from the Product in any manner whatsoever which may infringe any copyright or other proprietary interest of PCA Services or any other third party.
  2. Distribute, rent, sublicense, lease, sell, transfer, assign, modify, alter or adapt parts of or the entire Product or any related documentation or print outs without special permission from PCA Services, including all value-added features that are exclusive to one particular tool or Web site/service existing outside of PCA Services’s control.
  3. Use web robots, crawlers, wanderers or spiders in connection with the Product.
  4. Download the Product for use in any network, file server, virtual disk, timesharing, multiple CPU or other multi-user, bulletin board or remotely accessible arrangement without special permission by PCA Services.

Disclaimer

The Product and its content and this internet site are being provided ‘as is’ without any warranties of any kind. PCA Services, members, agents, employees, directors and suppliers expressly disclaim any such warranties, either express or implied, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, freedom from infringement or freedom from viruses. PCA Services does not warrant that the operation or availability of the Product or the Internet access will be error free or without interruption. The User understands and accepts that any use of the Product and the internet site is entirely at the User’s own risk and the User agrees to take appropriate measures to safeguard its data and information from any Product or Internet site malfunctions.

Limitation of liability

In no event shall PCA Services, its affiliates, agents, employees, directors, suppliers or marketing partners be liable for direct, indirect, special incidental or consequential damages arising out of the use or inability to use the Product, even if advised of the possibility of such damages. Specifically, PCA Services, its affiliates, agents, employees, directors, suppliers or marketing partners shall not be responsible for any costs, including, but not limited to, those incurred as a result of lost profits or revenue, loss of use of the Product, loss of data, the costs of recovering data, the costs of substitute data, claims by third parties, or for other similar costs.

Severability

In the event that any provision in this section shall be invalid under the law of any jurisdiction, the validity of the remaining provisions shall not in any way be altered and a similar, enforceable provision shall be substituted in the place of the invalid or unenforceable one.

Governing law and legal venue

PCA Services retains all rights not expressly granted in this Agreement. Nothing in this Agreement constitutes a waiver of the rights of PCA Services, or any third party under any law. This Agreement shall be governed by Norwegian law. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the Norwegian Courts.
